School Funding: A Matter of Safety

The Tennessean offered this opinion today on school bus safety:

The National Transportation Safety Board has shifted its position on the issue, recommending that the addition of lap/shoulder seat belts could enhance safety features already built into the buses, saving more lives.

This is an issue that has been left to individual states to decide. The Tennessee General Assembly should give McCormick’s proposed school-bus-seat-belt legislation a good debate, and then pass it.

Yes, catastrophic school bus accidents are rare, but when it comes to the safety of children, rarity and cost should not be an issue.

Six dead children and more than a dozen injured in Chattanooga makes that point quite well.

The article references the recent tragedy in Chattanooga and notes Governor Bill Haslam calling for a safety review:

Tennessee Gov. Bill Haslam last week promised he would mobilize state government for a thorough review of the school bus process that would include everything “from how we hire drivers, to how we ensure safety of the equipment, to whether there’s seat belts on those buses.”

Interestingly, in 2015, when legislation was proposed to add seat belts to school buses, Haslam’s Administration expressed skepticism, according to the Knoxville News-Sentinel:

Rep. Joe Armstrong says he will continue to push for passage of a law requiring seat belts on school buses this year despite skepticism voiced by officials of Gov. Bill Haslam’s administration and some fellow legislators.

So far, despite attempts by legislators including now-House Speaker Beth Harwell, no seat belt legislation has passed in Tennessee.

Instead, the General Assembly spends a fair amount of time helping districts save money by extending the life of buses. Andy Sher in the Chattanooga Times-Free Press reported in 2014:

School districts that own their own school buses may get some relief as a new bill approved by the Tennessee General Assembly will allow school buses to stay on the road longer.

The bill, which is projected to save local school systems an estimated $56 million in the 2014-2015 school year alone, was given final approval by the House on Monday following its passage last week by senators.

Sponsored by Rep. Ron Travis, R-Dayton, and Sen. Mike Bell, R-Riceville, the bill authorizes the use of conventional and Class D school buses until their 18th year of service. Buses that are older can go beyond that time limit provided they have less than 200,000 miles and are inspected twice annually.

The effort to extend the life of buses combined with the failure of efforts to require seat belts ultimately comes down to the issue of money versus safety.

So, in a state that significantly under-funds schools, districts are forced to choose.

While it is encouraging to see lawmakers and Governor Haslam now examining bus safety, we shouldn’t have to wait for a tragic accident to take steps that could save lives.

WTF ASD?

On the heels of announcing bold expansion plans that may take it to Chattanooga, the Tennessee Achievement School District received some bad news from state auditors.

Andy Sher at the Chattanooga Times-Free Press reports:

The audit said that the Comptroller’s office has previously “reported deficiencies in ASD’s internal controls and noncompliance with federal program requirements, resulting in approximately $721,000 of federal questioned cost.”

Sher notes:

On March 30, 2016, the U.S. Department of Education, Office of Inspector General, released an audit of Tennessee’s Race to the Top grant, which included funds spent by the ASD.

“This federal audit identified similar internal control deficiencies and areas of federal noncompliance with the Race to the Top grant at ASD,” the latest Comptroller notes. “During our current audit, we continued to find similar issues relating to fiscal deficiencies and noncompliance, but we have also identified new areas of deficiencies related to human resources and purchasing cards.”

At a legislative hearing today, Tennessee Department of Education Deputy Commissioner and Chief Operating Officer Kathleen Airhart told lawmakers that as of July 1, the Department now oversees the ASD’s finances. Airhart said the problems in the audit have been addressed.

Who could have guessed that a school district that spends its funds on cocktail receptions and then hides the social media invite when called out would have problems with fiscal management?

Not to worry, though, now the Department of Education is overseeing ASD operations. Yes, the same group that brought Tennessee the not-so-impressive TNReady rollout is now managing the ASD’s fiscal policy.

Sher called the ASD’s financial management “chaotic” in his article.

The reality is, the entire ASD has been chaotic and rather disruptive.

Auditors are in the business of finding mistakes, of course. It would be one thing if the ASD had a stellar track record of proven results and could blame the audit findings on an unrelenting focus on student success. Unfortunately, the evidence so far suggests otherwise.

So, you have a state-run school district that is failing to produce promised results at the same time it’s spending money with little oversight. So far, that hasn’t resulted in a halt to the ASD’s expansion plans.

Will 2017 be the year the legislature finally regains control of the district it created?

Huffman Responds to Critics

After learning yesterday that at least 60 Directors of Schools from across the state had signed a letter essentially expressing limited confidence in his leadership and challenging his approach, Commissioner Kevin Huffman responded today by saying:

We are committed to doing whats right for kids and we’re going to continue to be committed to doing whats right for kids. It’s important we talk to people, it’s important we listen to people, it’s important that people have input.

“But,” Huffman said, “at the end of the day we’re going to make decisions that are in the best interests of children in Tennessee.”

The Times-Free Press story also includes a poll asking if readers support Huffman’s ouster.

Apparently, Huffman believes continuing to attack teachers and dis-incentivize entry into the profession is good for kids. Or, maybe he knows better than almost half of the state’s Directors of Schools how to help kids achieve? Or, perhaps his collaborative style is so incredible these Directors have been consulted by him and they don’t even realize it?

 

Virtual Schools in Tennessee

In the wake of the renewed K12 dust-up, Andy Sher over at the Times Free Press has another good article out this morning highlighting a new bill put forward by the Haslam Administration to cap online school enrollment.  By the way, let it be known that the Times Free Press (and Andy Sher) have had consistently excellent coverage of this issue over the past year.  Whether it’s because Chattanooga native (and almost certainly next Mayor) Andy Berke started the anti-virtual schools crusade (and then homed in on* K12 as its dismal performance became public), or because K12’s Tennessee “home” is in Union County, just a ways down the road from Chattanooga, who knows.

Here’s the important point to take from Sher’s article today:

Haslam’s legislation would apply to the Tennessee Virtual Academy and any other online schools that come down the path. House Majority Leader Gerald McCormick, R-Chattanooga, who is carrying the administration’s package of bills, said Tuesday he had not been fully briefed on the measure.

Huffman spokeswoman Kelli Gauthier said in an email, “This bill is meant to enhance the accountability for virtual schools, and to base their future growth on demonstrated performance.

“This is not about K12; this is a matter of learning from the first year of implementation of the Virtual Schools Act and making improvements with a focus on student achievement,” she said.

The bill restricts new operators of online schools to no more than 1,500 students. After students demonstrate they are indeed learning through state achievement tests, they can enroll no more than 5,000. That cap also applies to K12 Inc.’s operation, Gauthier confirmed.

Another provision in the bill restricts a county online school’s ability to accept students from outside the local district.

That initially would not apply to K12 Inc.’s current student population in Union County. But Gauthier confirmed that in the future it would apply to new students.

That’s right.  K12 is not on its own here.  Aside from the prospect of future virtual schools, there is already at least one other virtual school operating in Tennessee.  Did you know that Metro Nashville Public Schools has its own virtual school?  It’s true!

For all of the protesting by the spokeswoman for Commissioner Huffman, this most certainly is about K12 and the Tennessee Virtual Academy.  What the response signals, however, is that the current legislature (and Governor and Commissioner) appear to be unwilling to backtrack on virtual schools entirely, as many K12 critics would like.  Instead, the measure put forward would be a compromise, while still preserving the opportunity for growth in Tennessee of (1) virtual schools and (2) for-profit school operators.**

*It is unclear whether the correct usage is “home in on” or “hone in on.”  I have used the former, because it appears to make more sense grammatically.
